Florida Head and Neck Injury Lawyer (Whiplash)

Head and neck injury attorney, Edward Rosado.

When a vehicle collides with another, it causes the body and particularly the head to accelerate and decelerate rapidly. In this situation, the force of the impact forces the head to move upward (above the headrest) and the force of the impact will normally cause the head to fully extend backward. Once the head is fully extended backward, the head will whip forward until it is fully flexed.

This violent action normally causes tearing of the muscles and ligaments. Furthermore, this action can cause the disc between the vertebrae to bulge, tear, or rupture. It can also cause the vertebrae to be forced out of position, causing the spinal cord and nerve roots to be pinched, irritated, or stretched. Injury could actually be worse if your head was turned at the moment of collision.

Pain can start immediately upon impact or it may take hours, days, or weeks before you start feeling pain.

Whiplash will normally cause a person to suffer with:

  • Headaches
  • Neck pain
  • Back pain
  • Vertigo
  • Nausea
  • Depression
  • Sleep dysfunction
  • Shoulder pain
  • Numbness
  • Tingling
  • Muscle spasm

Some symptoms relating to whiplash are similar to symptoms from brain injury.

Treatment of Whiplash

There are severe cases that require surgery. These cases are easy to document; however, conservative treatment is normally administered first to injuries not requiring surgery. Among other things, conservative treatment usually consists of ice/hot packs, spinal manipulation/mobilization, physical therapy, ultrasound, electronic stimulation, medication, and injections.

The Importance Of Having An Attorney And Doctor Team Protecting Your Best Interest

Cases requiring only conservative treatment are more difficult to prove in court. Consequently, a person suffering with such injury needs to be treated by a physician who knows what to look for and how to properly document the case.

The treating physician must be able to distinguish pre-existing conditions, and degenerative disease from the whiplash injury; such as: blood vessel destruction, disc herniation, chemical irritation to nerve roots, nerve compression, stenosis, etc. Furthermore, the physician must be able to properly document the difference; otherwise, your case will be prejudiced.

At Rosado Law Firm, we are able to refer you to competent doctors who know how to protect your case and work with the attorney handling your case to assure that the attorney understands the complexity of your medical problems.
